Terms of Service

Acceptance of Terms

By accessing or using the Overachiever application and website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Account Registration

To use the Service, you must create an account. You agree to:

• Be at least 13 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

Subscription and Billing

Overachiever offers free and paid subscription tiers. For paid subscriptions:

• All payments are processed securely through Stripe
• Subscriptions are billed monthly and automatically renew until cancelled
• New accounts receive a 14-day free trial of Pro features with no credit card required
• You may cancel your subscription at any time from your account settings
• Upon cancellation, you retain access until the end of your current billing period
• No refunds are provided for partial months of service
• If you downgrade, campaigns beyond your new tier's limit will be paused (not deleted)

Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Send spam, unsolicited messages, or harassing content through connected channels
• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use the AI message generation feature to generate harmful, misleading, or illegal content

Intellectual Property

Your Content: You retain ownership of all custom campaign content you create (text messages, images, campaign configurations). By using the Service, you grant us a limited license to store, process, and deliver your content as part of the Service.

Template Content: Curated campaign templates and their content are licensed for use within the Overachiever Service. Template content may not be extracted, redistributed, or used outside of the Service.

Our Service: The Overachiever application, website, brand, and all associated intellectual property are owned by Overachiever. You may not copy, modify, or distribute any part of the Service without our written permission.

AI-Generated Content

Messages generated by the AI feature are provided as suggestions. You are responsible for reviewing, editing, and approving all AI-generated content before it is used in your campaigns. We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated messages.

Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Overachiever shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Overachiever operates, without regard to its conflict of law provisions.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting a notice on the Service or sending you an email. Continued use of the Service after changes constitutes acceptance of the new Terms.
